The Alpine Canada – Win with ACA Contest

Official Rules and Regulations

The Alpine Canada  – Win With ACA Contest (the “Contest”) is intended only for individual residents of Canada, who have reached the age of majority of their province or territory of residence at the time of entry. This Contest will be interpreted according to federal and provincial law. Alpine Canada Alpin (hereafter referred to as the “Sponsor”) will conduct the Contest. 

  1. CONTEST PERIOD:

The Alpine Canada  – Win With ACA Contest begins on January 24, 2017 at 12:00:01 AM ET and concludes February 12, 2017 at 11:59:59 PM ET, the Contest Closing Date (hereafter referred to as the “Contest Period”).

  1. ELIGIBILITY

Employees, officers, and directors (their immediate family members and members of the same household of such persons, including common law spouses) of Alpine Canada (the “Sponsor”) its affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest are not eligible to enter the Contest. Entries may be made only by the original, manual keystrokes of the individual entrant without assistance of any kind including mechanical, form filling, other software or robotic assistance. By participating in this Contest, you signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”).

  1. HOW TO ENTER

No purchase necessary. To register for the contest and to receive one (1) Contest entry go to info@alpinecanada.org and submit a 150 word essay on why you love the HEAD Rebel Club along with a valid email address, confirm you have read and agreed to be bound by these Rules. Limit one (1) entry per person (regardless of the email addresses, telephone numbers or addresses provided throughout the Contest Period).

If it is discovered that you attempted to enter more than once each day during the Contest Period, then all of your entries in this Contest will be disqualified. Multiple registrations during the Contest Period by the same person using any device or method to register multiple times or as multiple Contestants will result in disqualification.

  1. PRIZES

One (1) Grand Prize will be awarded. The Grand Prize consists of:

One (1) HEAD Ski Package & a ski experience with a Rebels Club athlete in Mont-Tremblant (March 24-26)

Approximate retail value of the Grand Prize is $1,500 CDN.

Twenty (20) secondary prizes will be awarded, consisting of one (1) HEAD hats

Approximate retail value of the Secondary Prize is $20 CDN.

Prizes must be accepted as awarded without substitution, is not for resale and has no cash surrender value. The Sponsor reserves the right, in the event that a Prize cannot be awarded as described for any reason, to substitute another prize or prize component of equal or greater value, without liability. Prizes will be delivered to each winner’s residence within four to six weeks once all necessary documentation has been received from the prize winner. Limit one (1) prize per person/ household.

  1. PRIZE DRAWS

Grand Prize and Secondary Prize Draw

At 2:00 PM ET on February 13, 2017 (the “Draw Date”), in Calgary, Alberta one (1) entrant will be randomly selected as the potential Grand Prize winner from amongst all eligible Entries received during the Contest Period. Odds of winning will depend on the number of eligible Entries received during the Contest Period. Grand Prize Draw Date referred to as “Draw Date.”  Secondary prize draw will follow Grand Prize Draw.

  1. NOTIFICATION AND QUALIFICATION OF SELECTED ENTRANT

The Grand Prize and Secondary Prize winners will be notified within 5 days of the Draw Date by e-mail or telephone.  In order to be declared a winner, selected entrant must be in compliance with these Contest Rules and must first correctly answer, unaided, a time-limited, mathematical skill-testing question. The Grand Prize and Secondary Prize winners will be required to sign and return a Declaration of Eligibility and a Liability/Publicity Release within five (5) business days of notification, which, among other things, (i) requires the selected entrant to confirm compliance with these Rules; (ii) requires the selected entrant to release the Releases (defined below), and their successors and assigns from any and all liability, actions, causes of action, claims, costs and payments for damages, loss, injury or death, however arising or resulting from the awarding, use or misuse of a Prize or the selected entrant’s participation in the Contest, and (iii) gives permission to the Sponsor and its affiliates or agencies to use the selected entrant’s name, address, comments, entry, photograph and other likeness in any advertising or other publicity in any form of media without payment or further compensation, and without liability to the selected entrant or to his/her heirs. If a selected prize winner cannot be contacted by email or telephone, fails to correctly answer the skill-testing question or fails to return the Contest documents within the specified time, he/she will forfeit their prize and an alternate winner may be randomly selected at the absolute discretion of the Sponsor from amongst all remaining Entries eligible to win the respective Prize.  The Contest Sponsor’s rulings are final and without appeal in all matters related to the Contest and the awarding of the Prizes.

  1. GENERAL

All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the official Contest rules may be disqualified by the Sponsor.  Sponsor will not be responsible for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for any problems or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet or at any website and assumes no liability for damage to entrant's or any person's computer resulting from participating in the Contest. Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of the Sponsor and will not be returned.  All entries made by robotic or other automated means will be disqualified.

By entering this Contest, entrants expressly agree to receive direct messages, whether by electronic means, including direct messages on Twitter, Facebook, or other social media, or otherwise, from the Sponsor and its agents for the purpose of conducting the Contest, as outlined herein. In addition, entrants release and hold harmless the Sponsor, its affiliates prize suppliers,  advertising and promotional agencies, and their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively the “Releases”) from any liability in connection with this Contest or, if declared a winner, the awarding of, or use or misuse of, the prize. By accepting a prize, each winner consents to the Sponsor’s use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.

This Contest will be run in accordance with these Contest Rules, subject to amendment by Sponsor. Contest entrants must comply with these Rules, and will be deemed to have received and understood the Rules by participating in the Contest. The terms of this Contest, as set out in these Rules, are not subject to amendment or counter-offer, except as set out herein.

The Sponsor assumes no responsibility for failure of the Internet or the Website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email to be received or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. 

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. 

For Quebec residents:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling.  Any litigation respecting the awarding of the Prizes may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest’ server machine(s).

When you enter the Contest, the Sponsor will collect and use the personal information you provide on entry for the purposes of Contest administration and Prize fulfillment. By entering the Contest you consent to such collection and use. Personal information will be maintained by the Contest Sponsor, and its agents for the purposes of this Contest.

The eligible Prize Winner agrees to cooperate in any investigations by or on behalf of Sponsor to confirm their eligibility and to help ensure that the use of any such potential winner and/or their photo in advertising or publicity for the Contest will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Contest or the Sponsor as determined by the Sponsor in its sole discretion.
